The following terms and conditions apply to the commission service provided by Laura Valentine (Valentine Portraits) to you, the client.

Introduction
Thank you for choosing to commission a pencil portrait. By placing an order, you agree to the following Terms and Conditions. These terms outline the process, responsibilities, and expectations for both the artist and the client.

1. Commission Agreement
By commissioning a pencil portrait, you are entering into an agreement with the artist. This agreement outlines the terms for the creation, payment, delivery, and rights associated with the portrait. It is not necessary for the client to have signed any document for these terms and conditions to apply. If the client commissions a portrait from Valentine Portraits then the client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any commission or use of services implies that you have read, understood and accepted these terms and conditions.

2. Commission Process
a. Order Placement

To initiate the commission, the client must provide clear and high-quality reference photos of the subject(s) to be depicted in the portrait. The artist is not responsible for poor-quality images or unclear details that affect the final artwork.

The client should also specify any preferences for style, background, size, and additional details when placing the order.

b. Timeline

The artist will provide an estimated completion date after reviewing the reference photos and discussing details with the client.

The typical time frame for completing a pencil portrait can range from 2 to 8 weeks, depending on the complexity of the portrait and the artist’s current workload.

The artist will communicate any delays or changes to the timeline.
c. Revisions
-
The client is entitled to two rounds of revisions after the initial draft is completed. Revisions must be requested within 5 days of receiving the draft.

Any major changes after the revision period may incur additional charges or require a new agreement.

3. Pricing and Payment
a. Pricing
-
The price of the pencil portrait is determined based on factors such as size, complexity, number of subjects, and additional elements.

A full breakdown of the pricing will be provided upfront before starting the work.
b. Payment
-
A non-refundable deposit of 20% is required to secure your commission.

The remaining balance is due upon completion and before the final portrait is delivered.

Payments are accepted via PayPal or bank transfer.

All prices are in GBP (£) and may be subject to additional taxes or fees, depending on location.

4. Delivery and Shipping

For physical portraits, prints and cards, the artist will carefully package and ship the artwork to the client’s specified address once the balance is paid.

Shipping costs will be calculated based on the client’s location and the size of the artwork and discussed before starting the drawing.

The artist is not responsible for any damages during shipping or for delays caused by the shipping carrier.

The Client agree's to reimburse Valentine Portraits for any additional expenses incurred for the completion of the work. For example, postage charges and extra travel expenses for delivery etc.

5. Copyright and Usage Rights
a. Artist’s Copyright

The artist retains the copyright to the artwork. This includes the right to display the portrait in portfolios, social media, promotional materials, or other public uses. Please note your portraits will not be reproduced unless requested by yourself for prints, cards etc. If you wish to keep your portrait from being shared on the website and social media, please let the artist know and they will not be posted.

The client is granted a personal, non-exclusive license to display the portrait in their home, on social media, and for personal use only.
b. Commercial Use

The client may not reproduce the portrait for commercial purposes (e.g., selling prints, merchandise, or promotional materials) without written permission from the artist.

If the client wishes to obtain commercial rights to the portrait, an additional fee will apply.
c. Credit
-
It is requested that the client credit's the artist when displaying the portrait online, using the artist’s name or website handle (e.g., @valentineportraits).

6. Cancellation and Refunds
a. Cancellation
-
If the client wishes to cancel the commission before work has started, the deposit will be refunded.

If the client chooses to terminate the services of Valentine Portaits after agreeing a commission arrangement but before the commissioned project is complete, Valentine Portraits reserves the right to retain any non-refundable deposits paid. Should the client cancel the commission agreement after the artwork has been completed, Valentine Portriats reserves the right to charge up to 85% of the total projected costs. The scale of the charge will be dependent on the discretion of Valentine Portraits and the stage of the project at the time of cancellation.

If communication breaks down on the part of the client for a period of 30 days
(that is, the client fails to reply to a communication from Valentine Portraits)
Valentine Portriats will issue a warning email. If this warning email is not replied
to (and communication does not resume) with a following period of 30 days,
Valentine Portriats reserves the right to to terminate the commission. In this
event, all deposits paid will be rctained by Valentine Portraits and the commission
will be cancelled. -
If the client wishes to continue the commission at a later date they will be
required to request a new project quotation, sign a new Commission Agreement
and pay a further non-refundable deposit.

b. Refunds

Once the final portrait has been delivered, no refunds will be offered, as the work is personalized and unique.

If the client is unsatisfied with the final product after revisions, they may request a partial refund based on the extent of dissatisfaction, but this is at the artist’s discretion.

7. Client Responsibilities
-
The client is responsible for providing clear and accurate reference materials and detailed instructions for the portrait.

The artist cannot be held responsible for errors or misunderstandings due to unclear instructions or poor-quality reference photos.

The client must respond to communication from the artist in a timely manner to avoid delays in the process.

The client is responsible to not breach any copyright laws with the photos they provide.

8. Limitation of Liability

The artist is not liable for any indirect, incidental, or consequential damages arising from the commission, including but not limited to loss of data, financial loss, or personal dissatisfaction with the portrait (except in cases of gross negligence).

The artist’s total liability will be limited to the amount paid by the client for the commission.

9. Dispute Resolution
In the event of a dispute, both the client and the artist agree to make a reasonable attempt to resolve the matter amicably.

10. Amendments to Terms
The artist reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to the client before the commencement of new commissions.
By commissioning a pencil portrait, the client confirms that they have read, understood, and agreed to these Terms and Conditions.
